Terms of Service

1. Acceptance of Terms
By accessing and using the services of Forge Web Design Agency ("Forge," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Forge provides web design and development services including:
- Custom website design and development
- Mobile-responsive implementation
- SEO optimization and analytics setup
- Website hosting assistance
- Post-launch support (30 days included)
Services are provided on a project basis with terms outlined in individual project agreements.
3. Pricing and Payment
- Standard Package: $2,500 flat rate (one-time payment)
- Payment Terms: 50% deposit to begin, 50% upon completion
- Custom Projects: Quoted separately based on scope
- Refunds: Deposits are non-refundable after work begins. If we fail to deliver within agreed timeline, you may request a full refund.
- Late Payments: Projects may be paused if payments are not received as agreed
4. Project Timeline
Standard projects are delivered within 7 days from project kickoff. Timeline begins after:
- Deposit payment received
- All required materials and content provided by client
- Project scope and requirements confirmed
Delays caused by client (late content, delayed feedback, scope changes) will extend the timeline accordingly.
5. Revisions
The standard package includes unlimited revisions within the original project scope. Revisions outside the agreed scope or after project completion may incur additional charges. We aim to accommodate reasonable revision requests within 30 days of launch.
6. Intellectual Property
- Upon Full Payment: Client receives full ownership of the website design, code, and assets
- Before Full Payment: All work remains property of Forge
- Portfolio Rights: Forge retains the right to showcase completed work in our portfolio
- Third-Party Assets: Client is responsible for licensing any third-party assets (stock photos, fonts, etc.)
7. Client Responsibilities
Clients are responsible for:
- Providing all necessary content, images, and materials in a timely manner
- Providing clear and timely feedback during review stages
- Ensuring they have rights to all content provided
- Domain registration and hosting fees (if applicable)
- Maintaining backups of the website after handoff
8. Warranties and Disclaimers
We warrant that:
- Services will be performed in a professional manner
- Websites will be tested and functional at time of delivery
- Code will be original work or properly licensed
DISCLAIMER: Services are provided "as is" without warranty of any kind. We do not guarantee specific business results, conversion rates, or search engine rankings. Website performance may be affected by factors outside our control (hosting, content, market conditions).
9. Limitation of Liability
To the maximum extent permitted by law, Forge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid for services.
10. Indemnification
Client agrees to indemnify and hold Forge harmless from any claims, damages, or expenses arising from: (a) content provided by client, (b) client's use of the website, (c) violation of these terms, or (d) infringement of third-party rights.
11. Project Cancellation
- By Client: Client may cancel at any time. Deposit is non-refundable. Client pays for work completed to date.
- By Forge: We reserve the right to terminate projects if client violates terms, fails to provide materials, or makes unreasonable demands.
12. Support and Maintenance
Standard package includes 30 days of post-launch support for bug fixes and minor adjustments. After 30 days, ongoing maintenance and updates are available at additional cost. We are not responsible for issues caused by third-party modifications or hosting problems.
13. Confidentiality
Both parties agree to keep confidential information private during and after the project. This includes business strategies, proprietary information, and sensitive data shared during the engagement.
14. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from acts beyond reasonable control, including natural disasters, war, terrorism, pandemics, internet failures, or government actions.
15. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through:
- Good faith negotiation between parties
- Mediation if negotiation fails
- Binding arbitration in accordance with applicable law
These terms are governed by the laws of the United States.
16. Modifications
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of modified terms.
17. Entire Agreement
These Terms of Service, together with any project-specific agreements, constitute the entire agreement between you and Forge. No verbal agreements or promises shall be binding unless documented in writing.
